    Back to basics: SDS creation

    SDSs are an important document to communicate to downstream users about the hazards of a chemical product and measures for its safe handling. To date, however, there are many reports of non-compliance regarding the safety data sheets and this is due to various factors, such as the lack of information on the product or the substances contained and/or unfamiliarity with the legislation in force. This webinar aims to help companies get back to the basics of the REACH regulation, so that they can provide compliant SDSs and avoid non-compliant reports. During the presentation, the contents of the various sections of the SDS will be illustrated, in order to provide practical examples and simple solutions that can be implemented immediately.     Biocidal products must comply with the provisions of product legislation, specifically Regulation (EU) 528/2012 on biocidal products. A biocidal product, in order to be marketed and used, must contain approved active substances or must have been authorized by a dedicated Delegated Regulation. The Biocidal Regulation addresses topics related to the authorization of active substances, the authorization of the supplier to sell them, and the process to market a biocidal product in Europe. Additionally, the regulation also deals with the supply of treated articles containing biocides, such as paints treated with anti-mold active substances or other types of treatments carried out with biocidal active substances. Both biocidal products and treated articles must be classified, labelled, and packaged in accordance with the CLP Regulation, and a safety data sheet must be made available for all scenarios required by the REACH Regulation. Both are also subject to PCN notification requirements if they are hazardous mixtures. It is important to note that, by nature, treated articles require particular attention when drafting labels. This webinar aims to cover the main obligations imposed by the REACH and CLP Regulations for the supply chain actors, providing an overview and presenting examples of compliant SDSs and labels, particularly regarding treated articles.     CLP update: what you need to know

    The CLP Regulation has received a historic update. The Regulation’s amendments and additions will help it keep up with globalization and technological developments, such as the digitization of information to communicate along the supply chain, including, in this context, product labels. Another topic addressed are new sales methods, especially online sales which have become enormously widespread in recent years, allowing easy access also to non-European suppliers. Finally, the purchase of unpackaged bulk products is becoming more common, and the Regulation has carefully addressed this in terms of labelling and consumer availability. In addition to these, there are some aspects that have attracted the attention of market operators, as they will require their ongoing effort. Among them:
    • Label updates, as a complete remodelling of the graphic layout may be necessary.
    • The compilation of section 3 of the SDS will also see the presence of any impurities present in the formula, which will be "weighed" for the purposes of the CLP classification of the products in a different way than in the past.

    Cosmetic products are not subject neither to the CLP nor the REACH Regulation requirements, if they are in their finished state and intended for the end user. This means that there is no obligation to classify, label and package them as substances or mixtures nor to create and deliver SDSs, archive the material and make it available to workers. However, this does not apply to raw materials or semi-finished products, which fall completely within the scope of these standards. Furthermore, in some cases, cosmetics distributors may be interested in receiving documentation on the product to help manage safety measures in their establishments. In this webinar, we will review the regulatory context in which cosmetic products fall, address some elements of the SDS that can be particularly interesting in the world of cosmetics, and present a possible solution for safety documentation of finished cosmetics.     Detergent labels and SDSs

    Detergents are subject to Regulation (EC) No. 648/2004, which establishes the elements that must be included on the label according to the composition of the product, and the assessment of certain characteristics such as its biodegradability. However, detergents and cleaning products also fall within the scope of the REACH and CLP Regulations, so the supply chain actors shall comply with the obligations dictated by these regulations as well. Furthermore, when placing detergents on the Italian market, they must be notified with the PCN format as required by art. 45 of CLP Regulation even when they are non-hazardous or only hazardous to the environment.     From 1 January 2025, all mixtures marketed in the European Union must first be notified with the new Poison Centre Notification (PCN) format if they are hazardous to health or because of their physical effects. Therefore, throughout 2024, many companies have been working to make sure all their products meet this requirement. While doing so, it is normal to encounter different types of technical or theoretical challenges. Some of the specific difficulties posed by the notification process may be data collection for a large number of product or understanding how to solve validation rules sent from ECHA (QLT and BR codes).
